What is a Party Wall surveyor?
A surveyor appointed under the Act deals with the statutory process when relevant works are proposed and a dispute arises. The surveyor or surveyors may prepare a Party Wall award setting out how and when work may proceed, responsibilities between the owners and any other matters within the Act.
A schedule of condition may record the neighbouring property before work starts. The precise work required depends on the appointment and circumstances.
A surveyor appointed under the Act must act impartially, regardless of who appointed them. They do not act as an advocate for one owner.
When might one be needed?
The Act covers three broad situations:
- work on an existing shared Party Wall or structure;
- building a new wall at or astride the boundary; and
- excavation within the distances and depths defined by the Act near a neighbouring building.
The notice and response process differs by type of work. For some notices, written consent may allow the work to proceed without a surveyor under the Act. If an adjoining owner dissents or does not respond within the applicable period, the statutory appointment process may begin.
The Act has specific rules and deadlines. A surveyor should consider the actual proposal and documents before advising on the next step.
One surveyor or two?
The owners may jointly appoint one agreed surveyor, who acts impartially for both. Alternatively, each owner may appoint a surveyor and those two surveyors prepare the award together, with a third surveyor selected in accordance with the Act.
Which approach is appropriate depends on the matter, the parties and the work involved.
Who pays?
The building owner carrying out the work commonly pays the reasonable costs arising from the statutory process, including the adjoining owner’s surveyor where one is properly appointed. This is a general position rather than an absolute outcome; the award deals with costs for the particular matter.
