Party Wall Surveyor Surbiton
Surbiton is generally associated with the Royal Borough of Kingston upon Thames, but a KT5 or KT6 postcode and a locality label are not planning-authority evidence. Long Ditton and other places close to the borough edge demonstrate why the full address should be checked on the current authority map before Kingston policy is cited in a Party Wall brief.

Kingston’s adopted and emerging plans must not be merged
Kingston’s Adopted Development Plan page still lists the Core Strategy 2012, Kingston Town Centre Area Action Plan 2008, South London Waste Plan 2022 and the London Plan. The town-centre action plan does not automatically cover a Surbiton address simply because Surbiton is close to Kingston town centre; use the adopted policies map for the parcel.
The replacement Kingston Local Plan is not adopted. Its Regulation 19 consultation opened on 6 July 2026 and closes at 11.59pm on 4 September 2026. The council intends submission in December 2026, examination in 2027 and possible adoption in 2028. Until adoption, do not replace the 2012 and 2008 documents with its proposed policies.

The current Residential Design SPD supplies measurable extension context
Kingston’s Residential Design SPD page says the document was adopted on 9 July 2013, took effect on 16 July and remains the council’s published householder guidance. The fact that a replacement Local Plan is being consulted on does not itself revoke this SPD.
Policy Guidance 33 says a single-storey rear extension should remain proportionate and subordinate. Its ordinary dimensional guidance is:
- depth generally no more than 3 to 3.5 metres;
- at least 50% of the rear garden retained, with very small gardens considered on their merits;
- maximum height of 3 metres for a flat roof;
- maximum height of 3.3 metres for a parapet roof; and
- maximum height of 4 metres for a pitched roof.
The same section says a different rear building line can justify a greater depth and a lower neighbouring house can require a smaller one. These are not automatic development entitlements.
For a single-storey side extension, Policy Guidance 35 says the width should generally remain below half that of the original house, the extension should stand at least 250mm from the boundary so guttering does not overhang adjoining land, and it should normally be set back at least 500mm from the original front wall. Two-storey and first-floor side work has separate guidance, including retention of a gap.
Those setbacks and extension depths are planning-design measures. They do not decide whether the line is unbuilt for section 1, whether work involves a party structure, or whether the section 6 distances and levels are met. Basement applications need a signed, four-topic assessment
Kingston’s current validation-requirements page says the local list was adopted on 1 May 2024. The linked Validation Local List is dated February 2024. It requires every application involving basement development to include a Basement Impact Assessment signed by a Chartered Civil Engineer or Chartered Structural Engineer. The BIA should address:
- land stability;
- structural stability;
- heritage and archaeology; and
- groundwater, surface-water drainage and flooding from all sources.
The Residential Design SPD also says new basement sleeping accommodation needs natural light and ventilation, visible features should be discreet, visible lightwells should reflect local character and should not exceed one underground storey, and subterranean proposals require a Construction Method Statement. Flood Risk Assessments are specified for the situations identified in the SPD.
Planning-validation material can usefully show proposed levels, structure and construction sequence. It is still a separate evidence stream from Party Wall notices. A BIA signature does not establish the adjoining foundation bottom, and a Construction Method Statement is not the plans-and-sections package required with a section 6 notice.
Surbiton has several heritage areas, not one uniform control
Kingston’s conservation-area directory identifies 26 borough conservation areas. The Surbiton advisory committee covers 11 separate designations, including Surbiton Town Centre, Claremont Road, St Andrew’s Square, Victoria Avenue, Surbiton Hill Park, Southborough and Riverside South. The council records the Surbiton Town Centre Conservation Area as 311 properties over 5.2 hectares, designated in June 1991. Its current page records no Article 4 direction. That statement is specific to that conservation area, not a promise for every Surbiton property.
At Seething Wells, a targeted Article 4 direction removes the stated right to erect fencing, gates and other means of enclosure at the filter-beds site. It was confirmed on 14 April 2021. It is not a general basement or extension direction for Surbiton homes.
Use the statutory gateways and conjunctions
The Party Wall surveyor guide gives the overall procedure. The legal classification for the Surbiton works should be written precisely:
- Section 1(1): the lands adjoin and are in different ownership; at the junction either no building stands or there is only a boundary wall that is neither a party fence wall nor the external wall of a building; and an owner is about to build on any part of that line. At least one month’s notice follows. Without consent to build astride the line, the Act permits the alternative of a wall wholly on the building owner’s land and at that owner’s expense.
- Sections 2 and 3: where the proposal exercises a right in section 2, the building owner ordinarily serves a party-structure notice at least two months before the intended start. It states the owner’s name and address, the nature and particulars of the work and the proposed start. Section 3(3) excepts written consent from every adjoining owner and occupier and compliance with a statutory dangerous-or-neglected-structure notice.
- Section 6(1): the owner must propose excavation, or excavation for and erection of a building or structure, within three metres horizontally from part of an adjoining building or structure and part of the proposed excavation, building or structure within those three metres must extend lower than the bottom of the adjoining foundations.
- Section 6(2): within six metres, the distinct condition is whether part of the proposed excavation, building or structure would meet a plane drawn downwards in the direction of the building owner’s excavation, building or structure at 45 degrees to the horizontal. The origin line is where a horizontal plane at the bottom of the adjoining foundations meets the plane of the external face of the adjoining building’s or structure’s external wall.
If section 6 applies, at least one month’s notice is required before excavation, accompanied by the prescribed plans and sections. The party wall notice guide explains how this differs from party-structure notice and the possible responses.
Kingston’s planning “45 degree rule” assesses daylight from a neighbouring habitable-room window. It is not the section 6(2) plane: its origin, purpose and geometry differ. Label the two separately in any drawing set.
Package the request around the actual property
Provide:
- the complete address and verified planning authority;
- the applicable conservation-area, Article 4 and adopted-policy map results;
- the extension dimensions measured from the original house and boundary;
- existing and proposed drawings showing the line of junction and shared structures;
- sections showing excavation depth, horizontal distance and any known adjoining-foundation level;
- the BIA, Construction Method Statement and flood information where relevant;
- existing notices, delivery evidence and adjoining-owner responses; and
- ownership and lease information for the interests potentially affected.
Where a foundation bottom is unknown, state that explicitly rather than treating proximity as a conclusion. If introductions are available and the administrator records your chosen introduction, compare the proposed work scope, records, inspections, exclusions and later-stage responsibility before appointment.
